What is the difference between an easement and right-of-way (ROW)?

An easement gives one person the right to use the property of another. The latter refers to the right you have over another individual’s land while the former refers to the use of one’s land for the benefit of adjoining lands. Right-of -Way allows an individual to enter your property and use it as a passage.

What are Pipeline Right-Of-Ways?

Pipeline right-of-ways (ROW) are strips of land of which pipelines are installed. These pipelines range in varying sizes and transport oil, natural gas and other products.

There are regulations that can restrict the development of properties within a certain number of feet from a pipeline; it is best to allow your attorney to research this information for you. Most right-of-ways are along rural properties; however those that run within the city must be researched to consider all city/county ordinances.

What are easements?

They are written agreements, or easements; between landowners and pipeline companies allowing pipeline companies to construct and maintain pipeline right-of-way across privately owned property. Most pipelines are buried below ground in a right-of-way, which allows the landowner to still use the property in most cases.
